About Trademarks    
A registered trade mark is a valuable legal asset for any business including creative enterprises.

For a modest investment, it gives you a legal, renewable monopoly on the use of your trade mark for the products and services for which it is registered. Such registered rights can acquire considerable value over time.

These rights are not conferred by a domain name or company name registration.

If you do not protect your trade mark by registration, your right to use the name in business on and off the web is always open to attack and to dilution (even if you have the URL and company name) and you will be at risk of losing the right to use the name and any associated URL altogether.

If you use a name that is already registered by someone else, you may be liable in damages to them for trade mark infringement and have to stop using the name. If this happens you will lose the goodwill and reputation you have built up in the name and will have to adopt another name. The commercial and legal cost of inadvertently using a name that is owned by another business can be considerable.

If you do not protect your own trade mark by registration, your business may be severely compromised if a third party, such as an ex-employee, aggrieved customer, agent or distributor, applies to register you name first.

You should never use a name in business until you know that it is free for use and registration and you should then register it as a registered trade mark. Trademarks are a very important specialist area to help protect and expand your business.
